Preemption Legislation Alert Information

Preemption legislation is statewide legislation that prevents municipalities from enacting stricter local regulations than those adopted by the state. Preemption legislation presumes that "one size fits all" legislation can be adopted across our very diverse state; to voice your opinion on the matter, contact your representatives today.

SAMPLE LETTER

Dear (Senator/Representative):

I am writing to express my concern and objection to preemption legislation proposed for this legislative session that would affect fertilizer regulations, wetlands and mining practices. Preemption legislation prevents local municipalities from making decisions that are responsive to the specific issues and conditions of their region and needs of their constituents. It forces a "one size fits all" solution in a state that is too diverse to accommodate such a legislative approach. Representative Bryan Nelson (R) Orange County, has stated he will be filing legislation this session to preempt local municipalities from being able to adopt stricter regulations on fertilizer thereby undermining one of the key features and recommendations of the Statewide Fertilizer Task Force.

We ask that you kill any preemption legislation in committee and not waste taxpayer money on bad legislative policy. Thank you for your attention to this issue.
